Terms and conditions

1. Scope and contracting party

These terms apply to consumer orders from the ROCK your BABY online shop. The contracting party is Cullatec GmbH, Saarland University, Building A 1.1, 66123 Saarbrücken, Germany, phone +49 160 95822847, info@cullatec.com. A consumer is a natural person within the meaning of section 13 BGB.

2. Order and conclusion of contract

Product displays do not constitute a legally binding offer. You submit a binding order by using the final order button. A purely automatic acknowledgement initially confirms only that the order has been received.

For advance bank transfer, we accept your order by sending the payment request; the contract is concluded at that point. For all other payment methods, the contract is concluded by a message expressly designated as an order or contract confirmation, and no later than dispatch of the goods. Payment authorisation or capture during checkout does not by itself constitute acceptance. If we exceptionally reject an order, we release the authorisation or refund any amount already charged without delay.

Contract languages are German and English. Order data and contractual terms are stored and supplied with the order message on a durable medium.

3. Prices, shipping and delivery

All prices are final prices including applicable statutory VAT. Delivery restrictions and shipping costs are shown before the order is submitted.

The delivery time shown for the selected product or set on the product page and during checkout when the order is submitted applies. For advance bank transfer, the delivery period starts on the day after full payment is received. For all other payment methods, it starts on the day after the contract is concluded. The delivery time stored with your order remains applicable even if the generally displayed delivery time changes later.

4. Payment and invoice

Checkout may offer advance bank transfer and, depending on the device and availability, credit or debit card, Apple Pay, Google Pay, Revolut Pay and Pay by Bank. Advance bank transfer becomes due with the payment request. Other payments are authorised or executed during checkout. The PDF invoice is supplied with the dispatch confirmation.

5. Retention of title

The goods remain our property until payment has been made in full.

6. Transport damage and warranty

If transport damage is apparent, please report it to the carrier and to us as soon as possible. Failure to do so does not affect your statutory rights. Statutory rights for defects apply.

7. Right of withdrawal and engraved goods

Consumers have the statutory right of withdrawal described in the withdrawal policy. The right does not apply to the specific item that has been engraved with a name individually selected by you. The right remains unaffected for non-engraved items and non-personalised parts of an order.

8. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

9. Obvious errors and order quantities

We may correct obvious errors in price, description or availability before accepting the contract, or reject the order. Amounts already paid will be refunded without delay. Orders recognisably intended for resale or of unusually large quantity may be rejected before acceptance unless separately agreed.

10. Product presentation and final provisions

Product images are illustrative. Slight material- and production-related variations in colour, grain, surface and detail may occur in wood, 3D printing and laser processing. The product description, scope of delivery and compatibility information are decisive.

German law applies, excluding the CISG. Mandatory consumer-protection rules of the country in which consumers have their habitual residence remain unaffected.
